Shipping & Final Sale Policy

Thank you for choosing an original piece of art. Each painting is one of a kind, and I want you to feel confident about what to expect when you purchase.

Original Artwork

Each original painting is created by hand and is truly one of a kind. Small variations in texture, brushwork, surface, edges, and finish are part of the character of an original work and are not considered defects. I do my best to provide accurate photographs, dimensions, and descriptions so you can get a good sense of the artwork before purchasing.

A Note About Color

I make every effort to photograph my paintings as accurately as possible. However, colors can look slightly different from one screen to another, especially if neon paint is used. Your phone, tablet, or computer settings—as well as photography and lighting—can affect how colors, brightness, texture, and contrast appear. The lighting in your own home can also change how a painting looks throughout the day. Because of this, I can't guarantee that the colors you see on your screen will be an exact match to the original painting.

If you'd like additional photos or have questions about a painting before purchasing, please contact me. I'm happy to help.

Shipping

Original artwork is currently shipped within the United States only. Your painting will be carefully packaged to help protect it during shipping. Shipping costs and available delivery options will be shown at checkout (except in cases where shipping is included). Once your artwork is on its way, you'll receive available tracking information. Delivery dates are estimates, and occasional carrier or weather delays may occur. Please double-check your shipping address when placing your order, no P/O Boxes please.

If Your Painting Arrives Damaged

I take great care when packing original artwork, but if your painting is damaged during shipping, please contact me as soon as possible. If possible, please get in touch within 3 days of delivery. Please keep the painting and all of the original packaging, including the shipping box.

I'll also need:

  • your order number;

  • photos of the damaged artwork;

  • photos of the outside and inside of the shipping box;

  • photos of any visible damage to the packaging; and

  • a photo of the shipping label.

These photos and the original packaging may be needed for the shipping carrier or insurance claim. I'll work with you to determine the appropriate solution. Because every original painting is one of a kind, an identical replacement usually isn't possible.

Original Artwork Is Final Sale

Please choose your artwork carefully, as all original artwork sales are final. I do not accept returns or exchanges on original paintings for a change of mind, personal preference, differences in how the artwork looks in your space, or reasonable differences between the colors shown on your screen and the original artwork. I want you to be happy and comfortable with your decision, so please feel free to contact me before purchasing if you'd like additional photos, details, or information about a painting. The final-sale policy does not take away any rights you may have under applicable law or prevent you from contacting me if your artwork arrives damaged.

Caring for Your Artwork

To help protect your painting, avoid displaying it in areas with excessive moisture, heat, or prolonged direct sunlight. Please use appropriate hanging hardware for the size and weight of the artwork. For larger or heavier pieces, professional installation may be a good option. My paintings come without existing hardware or framing so you can decide what is most appropriate for your space.

Questions about caring for your painting? You're always welcome to contact me.

Welcome to Sydney Nogle’s website. This website, sydney-paints.com, is operated by The East Grove Company, based in Downers Grove, Illinois. By visiting this website or purchasing artwork through it, you agree to these Terms & Conditions.

Orders & Availability

Original paintings are one of a kind and are generally available in a quantity of one. Occasionally, an artwork may sell before the website inventory has been updated. I also reserve the right to cancel an order if there is a significant pricing or listing error, a payment issue, suspected fraud, or another reasonable reason the transaction cannot be completed. If you purchase an artwork that is no longer available or I am otherwise unable to fulfill your order, your payment for that artwork will be refunded.

Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated. Applicable taxes and any other charges will be calculated or displayed during checkout as appropriate. Payments are processed through the payment options made available on this Squarespace website. Prices may change without notice, but a price change will not normally affect an order that has already been accepted.

Shipping, Artwork Appearance & Final Sales

Information about U.S. shipping, shipping damage, the appearance and color of artwork on different screens, final sales of original artwork, and caring for your artwork is provided in the separate Shipping & Final Sale Policy above. Please review that policy carefully before purchasing an original artwork. The Shipping & Final Sale Policy forms part of these Terms & Conditions.

Copyright & Ownership

When you purchase an original painting, you are purchasing the physical artwork. Copyright and other intellectual property rights in the artwork remain with the artist unless those rights are expressly transferred in a separate written agreement. Purchasing an original painting does not give the buyer permission to reproduce the artwork commercially, make and sell prints or merchandise featuring the artwork, license the image, or otherwise use the artwork for commercial purposes without permission from the copyright owner. The artist may continue to photograph and reproduce images of sold artwork for portfolios, websites, social media, exhibitions, publications, promotional materials, prints or reproductions where legally permitted, and other artistic or business purposes.

Website Content

Unless otherwise stated, the artwork images, photographs, text, graphics, designs, logos, and other original content on this website belong to Sydney Nogle Musselman and The East Grove Company or are used with permission. Please do not reproduce, republish, distribute, modify, or commercially use this content without permission, except where permitted by law.

I make reasonable efforts to provide accurate information and maintain a secure, functional website. To the fullest extent permitted by applicable law, Sydney Nogle Musselman and The East Grove Company is not responsible for indirect, incidental, special, or consequential losses arising from the use of this website or the purchase, possession, or use of artwork. To the fullest extent permitted by applicable law, total liability relating to a particular purchase will not exceed the amount paid for the artwork giving rise to the claim. Nothing in these Terms is intended to exclude or limit a right or liability that cannot legally be excluded or limited. Additional information concerning responsibility for the handling, installation, display, and care of artwork after delivery is included in the Shipping & Final Sale Policy above.
